Terms of service
For members, family, and friends · 이용약관
1. Who We Are
JonjaBird (전자버드) is a mail forwarding and support services company operated by HOVERNOTES LLC. We facilitate communication between incarcerated individuals in Korean correctional facilities and their families, friends, and other supporters outside. Our registered address and contact details are provided in the app.
2. Eligibility
You must be at least 18 years old to create an account. By signing up, you confirm that you are acting in support of the incarcerated individual you are connecting with — whether as a family member, friend, or other supporter. We reserve the right to verify your connection to the inmate and to refuse service if we cannot reasonably confirm it.
3. Services Overview
JonjaBird offers the following categories of service:
Mail-based services (paid per-request or via JonjaBird Credits):
- Letter forwarding (scan inbound mail, print and mail responses)
- AI-powered research
- AI-powered typing/transcription (handwritten → digital)
- AI-powered court document translation (Korean ↔ inmate's language)
- Photo printing
- Book purchase and delivery (subject to prison restrictions)
Non-mail services (paid separately):
- Money transfers to the inmate's prison bank account (구매카드)
- In-person visitation
- 보증금 (deposit) recovery assistance
Current pricing is listed in the app and on our website. Prices may change with 30 days' notice.
4. JonjaBird Credits
4.1 What credits are. Credits are a pre-paid balance that can be spent exclusively on JonjaBird mail-based services. When your connected inmate requests a service, the cost is deducted from their credit balance automatically.
4.2 Loading credits. You may load credits via Stripe (credit/debit card) or Wise (international bank transfer). There is no load fee — the full amount you send becomes available as credits.
4.3 Non-refundable. Credits are non-refundable once loaded. Unused credits remain on the inmate's account indefinitely and can be used for future services. If you believe credits were charged in error, contact us within 14 days to request a review.
4.4 Not cashable. Credits cannot be converted to cash, transferred to the inmate's prison bank account, or transferred to another inmate's account. Credits are for JonjaBird services only.
4.5 Balance visibility. You can view the current credit balance and a full transaction history (itemized by service) at any time in the app. We also include the current balance on every physical package we send to the inmate.
4.6 Low balance notifications. When the credit balance falls below the cost of one letter forwarding service, we will notify you via the app and/or email. You are under no obligation to reload.
4.7 Account closure. If you close your account, any remaining credit balance is forfeited. We recommend using or drawing down credits before requesting account closure.
5. Money Transfer Service
5.1 What it is. A standalone service for sending money to the inmate's prison bank account (구매카드). This is completely separate from JonjaBird Credits.
5.2 Fee. We charge a tiered transfer fee: 10% on the first $100 (USD equivalent), 5% on amounts above $100. The fee is deducted from the transfer amount before deposit.
5.3 What the fee covers. Receiving international funds, currency conversion to KRW, depositing to the inmate's prison account, and confirmation of delivery.
5.4 Processing time. Transfers are typically processed within 2-3 business days. Delays may occur due to banking holidays, Wise processing times, or prison administrative schedules.
5.5 Confirmation. You will receive confirmation once the deposit has been made to the inmate's prison account. We are not responsible for how the inmate spends deposited funds.
5.6 Distinction from credits. Money transfers and JonjaBird Credits are separate services. Loading credits does not transfer money to the inmate's prison account. Transferring money does not create JonjaBird Credits. If you want both, you must make two separate transactions.
6. Payment Terms
6.1 Currency. All prices are listed in USD. Payments in other currencies are converted at the rate provided by our payment processor (Stripe or Wise).
6.2 Payment methods. We accept credit/debit cards via Stripe and international bank transfers via Wise. We do not accept cash, cryptocurrency, or checks.
6.3 Failed payments. If a payment fails, the associated service request will not be processed. We will notify you and hold the request for 7 days before canceling it.
6.4 Receipts. Digital receipts are available in the app for all transactions.
7. Service Limitations and Disclaimers
7.1 We are not a law firm. JonjaBird is not a legal services provider. Our court document translation and typing/transcription services are administrative support tools. They do not constitute legal advice, legal representation, or legal counsel. We do not review, interpret, or advise on the content of any legal documents. If the inmate needs legal advice, they should consult a qualified attorney.
7.2 AI-powered translation accuracy. Our translations are produced using AI technology and are intended to provide general comprehension of document contents. They may contain errors, omissions, or inaccuracies. Translations are NOT certified, NOT suitable for official court submission unless reviewed by a qualified translator, and NOT guaranteed to be legally accurate. We provide a best-effort service for informational purposes.
7.3 AI-powered research accuracy. AI-powered research is compiled from publicly available sources and AI models. Information may be outdated, incomplete, or incorrect. We do not guarantee the accuracy of research outputs. The inmate and their legal team should independently verify any information used for legal proceedings.
7.4 Delivery times. We mail documents via Korea Post (일반우편, regular mail). Estimated delivery is 2-4 business days within South Korea. We are not responsible for delays, losses, or damage caused by Korea Post. Express delivery (익일특급) is available for an additional fee but is also subject to Korea Post's service quality.
7.5 Prison restrictions. Korean prisons have rules about what inmates can receive. Certain services (book delivery, photo printing) may be restricted for inmates in specific categories (e.g., drug offenders on trial). We will inform you if a requested service cannot be fulfilled due to known prison restrictions, but we are not responsible for items rejected or confiscated by the prison.
7.6 Service availability. We reserve the right to modify, suspend, or discontinue any service at any time. We will provide reasonable notice of significant changes.
8. Prohibited Uses
You may not use JonjaBird to:
- Send threatening, harassing, or illegal content
- Facilitate criminal activity or escape planning
- Transmit contraband or instructions for obtaining contraband
- Impersonate another person or misrepresent your identity
- Send content that violates Korean law or the laws of the inmate's home country
- Attempt to circumvent prison communication regulations
We reserve the right to review outbound mail content for compliance. If we identify prohibited content, we will refuse to send it and may terminate your account.
9. Privacy and Data Handling
9.1 What we collect. Your name, email, phone number, payment information (processed by Stripe/Wise — we do not store full card numbers), the inmate's name and prison details, and the content of letters and documents you send through our service.
9.2 How we use it. Solely to provide JonjaBird services: processing letters, fulfilling service requests, sending notifications, and processing payments.
9.3 Who we share it with. We do not sell your data. We share data only with: our payment processors (Stripe, Wise), an analytics provider that helps us understand how the app is used, Korea Post (for delivery), and Korean authorities if required by law.
9.4 Data retention. In compliance with Korean law (개인정보보호법/PIPA and 전자상거래법/E-Commerce Act):
- Transaction and payment records: Retained for 5 years from the date of transaction (required by 전자상거래법 Article 6)
- Dispute and complaint records: Retained for 3 years (required by 전자상거래법 Article 6)
- Personal account information: Retained for the duration of your account plus 1 year after account closure
- Letter and document content (digital): See Section 10 (Document Handling)
9.5 Your rights. Under Korean PIPA, you have the right to request access to, correction of, or deletion of your personal information, subject to our legal retention obligations. Contact us through the app or by email to exercise these rights.
10. Document Handling
10.1 Physical documents. All physical letters and documents received from the inmate are scanned upon receipt. The physical originals are securely stored for 30 days after scanning, then shredded and destroyed. If you need the physical originals preserved, you must notify us within 14 days of our receipt.
10.2 Digital copies. Scanned copies of letters and processed documents (translations, transcriptions, research reports) are stored digitally for the duration of your account. Upon account closure, digital content is retained for 1 year for dispute resolution purposes, then permanently deleted — except where longer retention is required by Korean law (see Section 9.4).
10.3 Outbound copies. We do not retain copies of letters or documents sent from the family to the inmate beyond what is necessary for delivery confirmation. Outbound content is purged from our systems within 30 days of confirmed mailing.
11. Liability
11.1 Limitation. To the maximum extent permitted by law, JonjaBird's total liability for any claim arising from our services is limited to the amount you paid for the specific service that gave rise to the claim.
11.2 Exclusions. We are not liable for: actions taken by the inmate based on our translations or research, Korea Post delivery failures, prison confiscation of mail, decisions made by courts or legal authorities, or any indirect, consequential, or incidental damages.
11.3 Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including but not limited to natural disasters, government actions, postal service disruptions, or prison lockdowns.
12. Termination
12.1 By you. You may close your account at any time through the app. Pending service requests will be completed, but remaining credits are forfeited (see Section 4.7).
12.2 By us. We may suspend or terminate your account if you violate these terms, engage in prohibited uses, fail to make payment, or if we are required to do so by law. We will notify you of the reason unless prohibited by law.
12.3 Effect. Upon termination, your access to the app and all services ceases. Data retention obligations under Korean law continue regardless of termination.
13. Dispute Resolution
13.1 Informal first. If you have a complaint, contact us first. We will try to resolve it within 14 business days.
13.2 Governing law. These terms are governed by the laws of the Republic of Korea.
13.3 Jurisdiction. Any disputes that cannot be resolved informally shall be submitted to the jurisdiction of the Seoul Central District Court (서울중앙지방법원).
14. Changes to Terms
We may update these terms from time to time. The current version is always published on our website, and we will let you know about significant changes through the app or by email. Continued use of the service after an update means you accept the updated terms.
15. Contact
